Waste Industries Abandons Customers and Charges Them a Deactivation Fee

Even though this is a local issue in Gwinnett County Georgia, it could be affecting other unsuspecting customers in the United States. How can a company charge you a deactivation fee when they are discontinuing service? The company I’m referring to is Waste Industries, one of the largest Solid Waste Collection Agencies in the south, with reported annual revenue of over 100 million dollars. This is the company that I regretfully have had my service with.

In yesterdays’ post I gave a little background on a situation that is happening here in Gwinnet County Georgia. Gwinnett is limiting the number of trash collectors in unincorporated Gwinnett County to just two. We have had several trash collectors (one of which is Waste Industries) who either did not bid, or lost their bid, to continue service in Gwinnett County. I really wanted to give this post then, but I’m glad I waited until today. First of all I was able to give some background to those who are not aware, and secondly, there were some announcements made public this morning.

As you probably can tell by now, my service provider is/was Waste Industries. I received my final bill from them on Monday which should only reflect coverage through the end of the year. I was enraged when I saw the bill included a $23.50 deactivation fee. How could they charge this? I did not deactivate my service, they did. I was not in breach of contract in any way, and my bills were always paid on time. If anyone is in breach of contract it would be Waste Industries for not being awarded the contract through Gwinnett County. As far as I’m concerned they would still be welcome to pickup my trash if they had won the contract. Wanting to get to the bottom of this I wanted to check the Terms of Service on their web site. I found a big link just for those people in Gwinnett County. I found this following explanation from the CEO “Jim Perry” to be laughable.



Dear Valued Customer,


Waste Industries has enjoyed providing service in Gwinnett County for the past thirteen years and I would like to take this opportunity to thank each and every one of you for your loyal patronage. Regretfully, Gwinnett County has elected to take away your right to choose a waste hauler, and we will not be allowed to service you after December 31. Please be assured, however, that we fully intend to continue to provide outstanding service through the end of the year.


While we understand that this transition may cause you some inconvenience, please understand that this situation is solely a result of Gwinnett County’s action. We also ask that you consider the impact this will have on our local employees and their families. As a result of the County’s decision we are forced to close our Atlanta East branch. We are making every attempt to find jobs for these hard working men and women but, unfortunately, many of them will be without a job at the end of the year.


Your last invoice from Waste Industries will include an account deactivation fee. Please allow me to explain this charge. The modest $23.50 charge is a demobilization fee and not a rate increase. We regret being unable to issue advance notice of this fee, but Waste Industries was not informed that it had not been given the right to continue to provide service in the county until November 5. The short notice that we are now required to be out of the county by January 1 has placed substantial hardships on us. The fee addresses an array of additional costs and difficulties including, but not limited to:


• Demobilizing an entire branch.

• Extending employee COBRA health benefits beyond employment.

• Protecting a workforce that knows it will no longer be needed.

• Recovering assets.• Setting up call centers to deal with inevitable transition issues.

• Collection of accounts receivable in a short period of time.


As you can see from the examples above, the costs incurred by Waste Industries to demobilize will far exceed the amount it will receive through the deactivation fee.
We appreciate your understanding in this matter and hope to have the opportunity to serve you in the future.

Mr. Perry guess what, those bullet points are called a cost of doing, or not doing business. Most of which you would still have if you continued service in Gwinnett or not. You address me as a “valued customer”, and you thank me for my “Loyal Patronage”. Do you think I am a fool? I guess you don’t value my being a customer enough to win the contract. It is also obvious that you don’t want my loyal patronage to write to, or petition, Gwinnett County on your behalf. Obviously, you want to show thanks to your “loyal customers” by sticking us with the bill that finances your cut and run. If you had been awarded the contract, or even a portion of it, would I still be a valued customer and be paid an appreciation fee? I would bet not!

Well, I am not about to take this laying down. I sent a firm, but polite email to Gwinnett Clean and Beautiful regarding this issue Tuesday. Shannon Waldo from GCB kindly responded to me on Thursday with the following:


As Gwinnett County noted publically yesterday, they officially notified Waste Industries that they have allegedly violated the Gwinnett County Solid Waste Ordinance by charging an unauthorized de-activation fee. We cannot advise you to pay the fee or to not pay the fee, all we can advise is to direct your inquiry back to Waste Industries. Gwinnett County has stated that it will take any and all actions authorized by the Ordinance and law, including calling waste Industries performance bond.

I further inquired with her if any other company was trying to charge the same sort of deactivation fee. Her reply was that Waste Industries was the only one. I think if there was some sort of legal way to do this all of the companies would be doing it. I then called Waste Industries at a local number I found (678) 328-1650. I informed the person on the phone that I had no intention of paying that fee. He asked me for my address and said OK. He definitely did not want to talk about the issue but when pressed for some answers he would only say his company informed him it was totally legal for them to charge that fee. I don’t think this will be the end of it. This morning Benjamin Thomas, a lawyer representing Waste Industries, posted a reply to the allegation of Gwinnett County about Waste Industries violating a County Ordinance. In it, he defends the company’s action by stating, the additional fee does not fall subject to the ordinance because it is not an increase of the rate. He continues to threaten Gwinnett with legal action if they call in the $150,000 performance bond. The battle continues.

As for me, I have canceled my automatic bill payment and will be paying it manually. I don’t mind paying for services rendered, but my remittance will not include the deactivation fee. I will however include the following letter:





Dear Waste Industries,


Your attempt to levy a $23.50 deactivation fee to my final bill is unacceptable, and per Gwinnett County’s notification to you on 18-Nov-08, may not be legal, to the extent that they have mentioned revoking your $150K performance bond. Your response to this notification posted on your website today states that this is not a rate increase but an additional fee. I would have to argue. Per Mike Ingle, as interviewed by AJC, and Jim Perry CEO, this fee is to cover benefits to employees and other items related to loosing business in Gwinnett. These items as described are normally considered normal costs of doing business and are already reflected in your rate. I don’t mind if you keep your branches and employees in Gwinnett, so as far as I’m concerned you don’t have to fire anyone or shut anything down. Feel free to use these resources to service customers in neighboring areas where you are permitted to do business.


By no fault on my part were you unable to competitively bid for my business. If you and your employees are unable to continue my service due to contractual issues with the county, I was not in breach of any agreement. In fact, as a paying customer in good faith your fiduciary responsibility belongs to me, and if any breach of agreement has been committed, it would have been by your Company in failure to continue service. Gwinnett County may have given us both a raw deal. You lost my business and I lost the advantages of a free market. However, it is not my responsibility to recover your costs of doing business.


I explained my intention on this, to one of your representatives when I made a phone inquiry. He took my address and it was OK. I therefore, will pay my December bill as I always have, minus the $23.50.


I assure you if you try to impact my credit, place a lien against my property, or have a collection agent contact me, I will pursue legal action against you. I have been in contact with Gwinnett County regarding this as well, and I will be forwarding them a copy of this note later this morning.

NOTE OF SHAME:


We zealously guard our property against liens.

We are justly proud of our top-notch credit ratings.

What about our "good names"?


We always pay...and pay...and pay...and early.

We have been conditioned to this.

Hey Mike,
I'm thrilled that my response to WI (posted in Mack's blog) was useful to you in your rsponse to them! I was hoping it would be useful to someone. I hope it hits the mark.

I get so tired living among so many complacent, compliant little sheep, but I understand how they got that way. People think we're making too big a deal over this fee, but enough is enough! At what point do the "masses" finally draw the line? I'd love to see WI come after 200K residents who tell them to go jump in the lake. If enough people stood up to these bullies, it would be cost prohibitive for them to collect their little revenge fee.

As for the bullies at Langley Drive who starter this whole mess, they need to be tossed out on their ear at the earliest opportunity, but sadly, sheep have very short memories and are rather dumb.

We "subjects" send a very bad message to Gwinnett, Waste Industries, and any other predatory "suppliers" when we just give in and pay any old fee that they just tack on for any reason, knowing the "sheeple" will pay it. Usually the money grubbers would be right. Not this time folks.... There is strength in numbers.

I would like to link other like minded individuals’ sites to mine. Like you say if enough people stand up to them it would cost them too much to collect. I love your term "sheeple"; it is such a great description. But, I hate to say it, but the number of "sheeple" out there will make it hard to be cost prohibitive.

What I plan on doing, and really hope you join me, is taking our message to the national media. I believe a widespread negative Public Relations campaign will have a far greater impact than just a few people who want to stand out in the herd. If enough people like us promote this issue in front of the mainstream media, it might just take off.

Ah, folks, you are still singing my song and dancing my dance.

I commented earlier in "simulated representation" of the citizens who will not oppose the WI deactivation fee.

By the way, "sheeple" is anything but a new term.

I have spent so many years in frustration over the helplessness of the masses. It would, of course, be so rewarding to take a "productive stand".

Go national? By all means, do so if you can pull it off. It is a revenge fee by design, but these parasitic endeavors come in many designs, many names and many colors. These things work again and again from so many levels because there is not enough organized resistance. Go for it!

In summary, allow me to state:

Payment of the deactivation fee does not, in any way, indicate ignorance of the facts.

It only indicates the level of exhaustion of those who have walked this path forever.

As long as man is upon this earth, there will be those predators who will feed upon the prey.

I am aware, sirs, but powerless nevertheless.

Hey Mike,
No, I don't have a web site right now. But I'll be happy to carry this as far as is necessary. I spoke with a lawyer friend earlier today. My next service period with WI is the month of DEC 2008. Early this coming week, I plan to take my dumpster to their Pleasantdale Rd. facility, along with my bill, a check, and 2 copies of a termination letter, one for my records and one for them. My friend mentioned that, while wrong on one hand, on the other hand, they can add what ever fee they want, and if you continue with their service, you are technically assenting to their right to charge you that fee. If however, you reject the new terms (deactivation fee), you must terminate the service before that service period begins. Same thing as when a credit card company adds some new fee you don't like. As long as you pay off your balance, cut up your card, and close your account before the affected term begins, you're not subject to the new fee.

As for what I will do with my trash during December....I have some ideas.... where do our esteemed county representatives live?

I hope I didn't come across like you were one of the sheeple (and you're absolutely correct, I didn't come up with that- My term would have been much more derogatory about their intelligence, or lack thereof). The fact that you're posting shows you're one who take action, even if it's just to encourage others.

The problem in nearly all levels of politics & the governed is that the real workers are too busy working to keep up with all the sneaky little businesses of the politicians. This one got by us, unfortunately. I also fear you're probably right that most will find it easier to complain a little about the fee, resignedly pay it, and then move on with life until the next time something like this happens. Until one day, something they really care about is at stake, and then it's too late.

It is exhausting indeed to stay afloat amongst the constant barrage of these kinds of offenses, both from politicians and businesses. My only hope is that FINALLY the people of Gwinnett will have a boot print on their necks painful enough that they will REMEMBER THIS at the next election. They'll probably be too busy watching "Sheep Idol" to care.

Can I, or even a small band of sheep dogs, beat these predators by ourselves? Not likely, but I will derive a small amount of satisfaction by poking them in the eye and making their lives miserable every chance I get.

Hi KB,
I also considered the point that you and your attorney friend came up with. Of course, when I received my bill with the notification on it, it had already been at least two pickups into the next billing cycle, so technically I did use their service. But, this is not the only point I’m basing my actions on. As your lawyer friend stated, they MAY be permitted to add a fee to your bill, but these fees also have to be legal in nature. They are also required to give us prior notification. Even with the Credit Card companies, the new fees will be in effect the next billing cycle, not on your current statement.
As I noted, I believe this “deactivation” fee, as described by their CEO Jim Perry, is more or less a double billing. Accounts Receivable, Employee and Cobra Costs, retrieval of assets etc, are all costs of doing business in which we already pay in the rate. In reality, they are raising their rates to defray their business costs, and calling it a fee. They are doing this so it would not have to be approved by Gwinnett County. Additionally, I have not deactivated my service; they have stopped servicing me, by no fault of my own. It should be the other way around; I should be charging them a deactivation fee! As far as I’m concerned they can continue to do business. Because they have deactivated me I will have a transition process that I will have to endure. It was their choice not to service Gwinnett County, either by not bidding or, by submitting an inferior bid. In their actions, they clearly felt that their profit margins could not , met with a winning bid in Gwinnett County. Therefore, they are choosing to leave and defraying their costs solely on their previous customers in that county.
I, like JoJo, hope you inform us on your progress. What you should do is charge them a delivery fee for bring their trash can to them. I think I would be worth, let’s say, $23.50. (grin)

I returned my can yesterday and terminated my service (technically, I did not "continue" my service into the new billing period, December 2008. I put a full report on Mack's forum, look around 24-Nov. The local employees were super nice. I returned my can, and told them I I would not be continuing my service past Nov-30. I gave my address, but didn't make a big deal about "Gwinnett County" until everything was complete. They did remove the deactivation fee, and I didn't even have to ask for that. I was prepared for a fight, but prayed real hard before-hand that I wouldn't be forced to get "down & dirty" with them.

So, as far as my dealings with WI is concerned, that part is complete. However, my fight will now be with the scheming wolves who have instigated this mess on people trying to live their lives in good faith and paying their bills on time.

I figure I spent about $6 in gas round trip returning the can, and saved $46 (including the fee). So I'm now $40 ahead of the game, but have to deal with my own trash. And I do have a trash plan....

Unfortunately my billing with WI was quarterly, and didn’t correspond with the calendar. This quarter ran from November through January.

Actually, I’m not surprised they were nice and did not put up a fight. As I mentioned in my article, when I called and refused to pay, they took my address and said OK. At the time I too was prepared to fight, and was somewhat disappointed when the person I spoke to didn’t challenge me. After thinking about it, why would he? That poor person didn’t make any of the decisions or policies. I’m sure he was just a low paid hourly worker who possibly is loosing his job. He is probably more upset with WI than we are.


As far as the Gwinnett County government and its newly adopted socialist policies are concerned, I too will be fighting.

I am certainty taking a stand on this, but sending our bills to Gwinnett Clean and Beautiful (GCB) won't be enough. They don't care! They would just throw them away.

Here is a little update on what is going on and what is happening since I made this post. Waste Industries lawyers responded to the complaint raised by GCB. GCB claimed that the additional deactivation fee was an unapproved rate hike. WI claimed it is not a hike but a fee. It ended up going no where.

I haven't heard anything back from WI on my refusal to pay their fee, until yesterday. They sent me another bill. Guess what? The bill threatens that if I do not pay they might cancel my service. Hellooo! You already did.

I bet I'll hear more on this soon. I'm planing on being a big pain in the backside to WI. I filed a complaint with the BBB today and will follow it up with a complaint to the Governor's Office of Consumer Affairs. A great idea suggested by a reader who emailed me. Since they have not posted with a name, I'll respect their privacy. Anyway the complaint is as follows:

Waste Industries lost their ability to service my area (Gwinnett County, GA) buy either, not bidding on, or failure to win, a contract with the County. I had absolutely no input or influence in this decision. This may possibly have been due to the provisions set forth by Gwinnett Clean and Beautiful. In short, their failure to secure this contract reflects their election not to continue service.

They have decided to add a $23.50 deactivation fee to my final bill. Their CEO (Jim Perry) publicly describes this fee as a demobilization fee covering the costs of closing the Gwinnett Branch. Waste Industries has never announced such a fee prior to us receiving it in our final bill. Therefore we did not have a chance to challenge or opt out. When I called the local office and stated my objection to the fee, the person I spoke with took my address and agreed with me. I sent in the final bill minus the deactivation fee along with a letter stating why that fee was not paid. They are now trying to collect that fee in a subsequent bill. Since my account was in good standing, and their business losses are not related to my actions, I should not have to pay this deactivation fee. Especially since this fee is only targeted to those of us in Gwinnett County, and we did not have a chance to either agree to this or discontinue service.

THEY WERE USING A 12.3 MILLION DOLLAR COMPUTER AT THEIR CORPORATE OFFICE IN RALEIGH ON BENSON DRIVE TO HACK INTO ALL OF THE SURROUNDING GARBAGE COMPANIES AND TO STALK MY FAMILY AND FRIENDS THROUGH THE INTERNET. THESE PEOPLE WILL BREAK INTO HOUSES AND INSTALL WIRELESS LISTENING DEVICES AND CAMERAS TO PREPARE FOR TRIAL, AND FIND OUT WHAT IS BEING SAID ABOUT THEM. CHRISTOPHER MCCOWEN -

Christopher M. McCowen was convicted in the 2002 rape and murder of Christa Worthington, a former fashion writer whose family had lived in Truro, Massachusetts, for generations. McCowen was charged with the crimes in April, 2005, more than three years after the discovery of Worthington's body in her Truro home on January 6, 2002.


McCowen, who is African American, had lived on Cape Cod since about 1998 and had been a waste collector whose regular route included Worthington's home. McCowen was charged in 2005 on the basis of genetic fingerprinting from a sample he provided to authorities in March, 2004, thirteen months before he was arrested. On November 16, 2006, he was convicted of first-degree murder, aggravated rape, and aggravated armed burglary. He was sentenced to life without parole.


McCowen's trial lasted five weeks, and issues of class, race, rush to judgment, bungled forensics and the existence of other suspects were raised by Boston defense lawyer Robert A. George. The trial was covered nationally by the news media and was carried on a daily basis by Court TV. The jury deliberated eight days before coming to a verdict.


In January 2008, after a motion alleging juror misconduct during the trial and deliberations, a hearing was held due to three jurors' allegations that some racial bias was displayed during deliberations.

In the rebuttal for my BBB complaint, WI's attorney stated that they could charge a fee at any time. They say this was possible under the "Late Fees and Service Fees" section on the back of your bill. They also said that since this was a fee and not a rate increase that they did not have to have approval from Gwinnett County and only had to notify them in writing. This is under Sec. 4-2010 of the Solid Waste Collection and Disposal Services Ordinance.

The same section also states that "Amended schedules shall be filed if rates and fees change not later than the date such changes take effect." The letter of Amended Schedule from WI's lawyers was sent to Gwinnett County's representatives on November 20, 2008 that mentions that the deactivation fee would be added to the customer's regular bill. My bill is dated November 12, 2008. Doesn't that mean the rate was in affect before the 20th. Any body with better legal skills than me want to weigh in on that?

I still haven't seen a response to my BBB complaint, but from what you have posted here, and other posts I've been following, mine will probably be the same. As far as I'm concerned, they can say whatever they want, and I'm not surprised by this response. Just because they "reserve the right" to charge fees doesn't justify a fee as being legal. Let's say that I put a disclosure on my blog that says I reserve the right to add fees for services or late fees. I then decide not to write anymore because of whatever reason. It doesn't mean that I could then send each reader a deactivation fee and expect to be paid. If it did, I will have to change my business model.

As far as I'm concerned, Waste Industries can still be my trash hauler, therefore they do not need to deactivate my account. I believe they will even try to change the name of the fee from a deactivation fee to an asset recovery fee to pick up their trash can. Again as far as I'm concerned, they can leave it. I'm sure it would make a nice garden buggy. Or they could sell it to Waste Pro. I'm sure this would lower their startup costs in supplying and delivering new cans to everyone. If Waste Industries persist in their efforts to collect, I will just have to charge them a storage fee for each day it remains on my property after they discontinue service. If they refuse to pay me I will consider it abandoned property.

As far as the timing you mentioned there might be something to that as well. I believe these were being placed on bills right after the Charles Bannister signed the bill and GCB announced the winners on 11/7. GCB actually complained to Waste Industries on 11/19 and their response to GCB was on 11/20.

I'm curious as to what I can do about this. I began service with Waste Industries January of 2008 when I purchased my new house. I paid for 1 year's worth of service with my credit card. I don't recall signing anything, and I do not have any documentation with my signature on it. This is strange because I would have filed that away which leads me to believe that I did not sign anything.

For the sake of argument, let's say that I did, and misplaced the document. Because I paid for 1 year's worth of service, I never received any bills from Waste Industries stating anything about this deactivation fee.

So do Waste Industries or their attorneys have a leg to stand on with me? They have no signed document from me. I have complained with BBB, and their attorneys have sent their response. In short, they reiterate much of what they have said before. They are in their right to charge a deactivation fee, blah, blah, blah.

So what exactly can they do to me? I want to fight this, but am a little concerned with how this could play out. I don't even owe them the entire $23.50. I had credit for part of January, so I only owe about half of what they are asking. In reality, they owe me a refund for the service that they will not provide for half of January, but that is an issue that will be resolved with this fee. So to repeat myself, what can Waste Industries do to me if I don't pay?

I still haven't received a response to my BBB complaint, but I'm pretty sure they have a form letter type of response to these complaints. Especially in what you stated in your case. Your case sounds different then the ones I've heard so far. Keep in mind I'm not an attorney and only have my opinion, common sense and principals.

I do however have a couple of questions. Since you did not receive a bill from them, how did you even know about the deactivation fee? Did they even announce to you that they would be stopping your service? Have you contacted Waste Industries directly? If so, what was their response? Personally, I would demand a refund for services not rendered, and refuse to pay the deactivation fee. Has your case with the BBB been closed?

You ask what they can do? I'm not sure, but I'll bet they try to get as much money as possible from those who will just pay it. It has to be a big cash cow for them. I'm pretty sure they will want to see the outcome of the injunction case in Gwinnett before doing too much. If they want to pursue it, they will probably put it into their internal collections first. This will probably result in past due notices, threatening calls and letters. They could then report it to the credit agencies. But with the credit agencies, I believe you can also post your appeal. I don't think it would take long to eat up the deactivation fee owed in just postage for these. When all that fails, they could sell their bad debt to collection agencies who also could harass us. This sale would be for pennies on the dollar.

Hi, Mike,

Like I said above, I paid for 1 year worth of service using my credit card in January of this year. After that there was no correspondence from them until the bill they sent out to everyone in last month. On that bill it stated that I owed them the 23.50 deactivation fee minus the 10.30 in credit I have for them not satisfying the rest of their contract with me.

And again, I don't know if I can exactly call it a contract as I did not sign anything. So my question is how can they really pin anything on me when my signature is not on any documents stating that they reserve the right to charge termination fees?

I feel very unprotected in this. It just feels like we are being left here to defend ourselves, and how can we possibly fight again a company spending so much on a lawyer? Gwinnett County has already given up on us. Honestly, how do we fight this? I don't want to give in, but I certainly don't want to ruin my credit over 13.20. This just sucks.
